These Terms & Conditions apply to purchases made from Plastake through GeographicMarkers.com, by telephone, by email, or through an accepted purchase order.
GeographicMarkers.com and the Plastake business are currently operated by B & H Engineering, Inc.
Orders and Acceptance
Submitting an order does not guarantee that the order has been accepted.
We may contact you to confirm product availability, quantity, pricing, shipping information, payment arrangements, or other order details before accepting or fulfilling an order.
We reserve the right to refuse or cancel an order because of product unavailability, incorrect pricing or website information, payment or credit concerns, shipping restrictions, suspected fraud or misuse, or other reasonable business considerations.
If payment has already been collected for an order we cancel, the amount collected for the canceled portion will be refunded.
Product Information
We make reasonable efforts to accurately describe our products, quantities, dimensions, colors, and uses.
Minor variations may occur because of manufacturing processes, materials, display settings, or product improvements.
Customers are responsible for determining whether a product is appropriate for their particular application.
Pricing
Prices are shown in United States dollars and may change without notice.
The price applicable to an order is the price confirmed when the order is accepted.
Prices shown on the website may differ depending on order quantity, case versus exact-count ordering, payment method, special handling, expedited or nonstandard shipping, or custom arrangements.
If pricing information is incorrect, we may correct the error before accepting or fulfilling the order.
Payment
Payment is due according to the terms presented or approved for the order.
Available payment methods may include credit or debit card, ACH, check, cash, or an approved purchase order.
Discounted pricing may be available for certain payment methods. Any applicable discount will be shown or communicated before the order is finalized.
Customers purchasing under approved credit or purchase-order terms are responsible for paying invoices when due.
Taxes
Customers are responsible for applicable sales, use, excise, or similar taxes unless a valid exemption applies.
Customers claiming a tax exemption may be required to provide appropriate documentation.
Shipping and Delivery
Shipping and delivery are governed by our separate Shipping Policy, which is incorporated into these Terms & Conditions.
Shipping and delivery dates are estimates unless we expressly agree otherwise in writing.
If a shipment is lost or damaged before delivery, please contact us promptly so we can review the issue and work with the carrier toward an appropriate resolution.
Responsibility for the shipment generally passes to the customer once delivery is completed at the shipping address provided with the order.
Additional costs caused by an incorrect address, refused delivery, or customer-requested redirection may be the customer’s responsibility.
Returns and Refunds
Returns and refunds are governed by our separate Returns Policy, which is incorporated into these Terms & Conditions.
Customer-choice returns may be subject to a 20% restocking fee and return-shipping costs as described in that policy.
Product Use and Safety
Customers are responsible for selecting, installing, handling, and using products safely and appropriately.
Products should be used only for suitable marking or identification purposes and in accordance with any instructions, warnings, or applicable laws.
Plastake products are not represented as suitable for supporting people, securing heavy loads, preventing access to hazardous areas, or serving as safety barriers unless expressly stated in writing.
Warranties
We stand behind products that are materially defective when supplied.
Except for any express written warranty we provide, products are sold without additional warranties to the fullest extent permitted by law.
We do not guarantee that a product will be appropriate for every site, soil condition, climate, installation method, or customer application.
Limitation of Liability
To the fullest extent permitted by law, B & H Engineering, Inc. will not be responsible for indirect, incidental, special, or consequential damages arising from the purchase or use of a product.
Our total responsibility for a claim relating to an order will not exceed the amount paid for the product giving rise to the claim.
Nothing in these Terms excludes liability that cannot legally be excluded or limited.
Website Use
Website content, product descriptions, photographs, logos, and other materials are owned by or used with permission by B & H Engineering, Inc.
They may not be copied, reproduced, modified, or used commercially without permission, except as allowed by law.
You may not use the website to attempt unauthorized access, interfere with website operation, submit false or fraudulent orders, introduce malicious software, or violate applicable law.
Third-Party Services and Links
The website may use or link to third-party services, including payment processors and shipping carriers.
We are not responsible for third-party websites, services, outages, policies, or content.
Governing Law
These Terms & Conditions and any dispute relating to an order or the website are governed by the laws of the State of Indiana, without regard to conflict-of-law principles.
Any legal proceeding must be brought in a court with appropriate jurisdiction in Indiana, unless applicable law requires otherwise.
Changes to These Terms
We may update these Terms & Conditions from time to time.
The terms in effect when an order is accepted will generally apply to that order.
